FCRA Violations by Credit Reporting Agencies Can Get Your Credit Repaired Fast

The coronavirus has changed everything. Not just in the United States but in the whole world. The thing is, we can live in fear, or we can be smart. Maybe I’m crazy, but I prefer to be an optimist and try to see the good and the opportunity and everything. Always. Regardless of the situation. Many people are touting this as judgment day or the end of the world or any other of 100 different conspiracies. I am NOT saying we should act stupid, not at all. This is serious stuff and calls for serious people.

Are YOU Serious?

The question is, are YOU serious? Do You really want Credit Repair Fast? Are YOU interested in fixing or building your credit? Due to time constraints, there are lots and lots of violations to the FCRA happening right now. It is happening at all three credit bureaus: Experian, TransUnion, and Equifax. You can use this to win or you can ignore it and stay exactly where you are. The Choice is Always yours.

The fair credit reporting act is part of a larger law called the consumer credit protection act. It became law in 1970. It provides protection against either misuse or misreporting of your credit information. Much of it covers what happens when creditors, collectors, or credit reporting agencies make mistakes. See you guys already know it if there’s an error on your credit report it can cause a lower score. Obviously when its negative it’s going to cause a lower credit score. This can cause a denial of credit. It can cause higher interest rates on loans and credit extensions and more. When a Credit Bureau violates FCRA, You need to know. when you find out, you can take action, and get those negative marks removed from your credit report.

In a nutshell, FCRA governs the behavior of the credit reporting agencies. It also governs the behavior of businesses that report to the credit bureaus.

Here is the deal…

Here is what this means to you when it comes to your Credit Report. If a credit reporting agency has committed a violation you can have that account removed. When a creditor or debt collector commits a violation, you can have that account removed. Even if the debt is legitimate, because of that violation, you can have that account removed.

So here is how we’re going to get your credit repaired fast.

If there is any question about the accuracy of any item on your report, file a dispute. Credit bureaus and creditors are bound by law to take certain actions. They cannot sit on it. They MUST respond to that dispute.

Their duties include:

  • conducting a reasonable investigation
  • correcting inaccurate information and
  • removing disputed debt from your report.

There are ways they fall short on their duty’s guys.

We have seen them getting behind; especially during this crisis. So let’s look at exactly how they’re messing up so that you can use it to your advantage and repair your credit fast.

CRA’s Have SPECIFIC Deadlines

The main thing we’re going to be looking at today’s deadlines.

Many people are working remotely if there working at all. most businesses have closed down completely. Those that are open are only working at partial efficiency. FCRA deadlines are going to be working in your favor as the consumer. Their requirement to go slow is going to help YOU repair your credit fast.

Here are the four key deadlines to remember when dealing with the fair credit reporting act. These items directly affect any dealings with credit bureaus.

  • CRAs must correct or delete inaccurate information within 30 days of your dispute.
  • They have up to 45 days if you provide additional information. More on that in my post on Stall Tactics.
  • Anybody reporting negative information to a credit bureau must report it to you as well. This includes businesses, creditors, collection agencies; anybody. They must do it within 30 days. I’m going to cover that one in a different post next week.
  • The statute of limitations for filing a suit is two years after the date you discovered a violation. There is a second Statute of Limitations too. If you miss the first one, within five years of the date of the violation itself you must file.

Use TIME to Your Advantage

So here’s the thing folks, you want credit repair fast, right? we all do. The simple fact is 30 days to properly investigate and correct an error is hard enough. Based on the workload that the big three credit bureaus normally have it is daunting.

I already have the evidence to show that there is no way any credit bureau can do a proper investigation right now. I even gave a few case studies last week. On top of that the creditors are going to have to get back with them to verify the debt. They must and prove they have not made a mistake. And THEY are short-staffed too!,

How to get Credit Repair Fast

Based on this crisis, it’s your turn to stall them. Although that said, I would recommend this same behavior even if there wasn’t a crisis. Remember that the burden of proof is on them not you. They have to prove that everything is accurate. All you have to do is tell them to investigate because you think there’s an error.
